Legislation for 2010

 

All legislation introduced in 2009 is still valid for the calendar year of 2010.  Here is an updated listing of bills important to ABATE Members.

 

 

Good News:

 

SB104 amends the Michigan Vehicle Code to establish penalties for moving violations that seriously injure or kill another person.  It was passed into law on January 9, 2009 and takes effect on 10/31/2010.  The enacted penalties are:

-- A moving violation that causes serious impairment of a body function of another person is a misdemeanor punishable by up imprisonment for to 93 days or a maximum fine of $500, or both.

-- A moving violation that causes the death of another person is a misdemeanor punishable by imprisonment for up to one year or a maximum fine of $2,000, or both.

-- Reckless driving that causes serious impairment of a body function of another person is a felony punishable by imprisonment for up to five years or a fine of between $1,000 and $5,000, or both, and vehicle immobilization.

-- Reckless driving that causes the death of another person is a felony punishable by imprisonment for up to 15 years or a fine of $2,500 to $10,000, or both, and vehicle immobilization.

Catastrophic Claims Bills:

 

SB160 and HB4471 

These bills mandate the MCCA adhere to the Open Meetings Act, and the Freedom of Information Act.

            HB4471 � Passed the House on 4/1/09.  On 4/2/09 � Referred to Senate Committee on Economic Development & Regulatory Reform, where it is still as of 1/25/2010.  Also, 4471 is tie-barred to HB4427 (Rep Kate Segel introduced) which adds a yearly audit component to the legislation.  HB4427 also passed house on 4/1/09 and also referred to Senate Committee on Economic Development & Regulatory Reform, where it still is as of 1/25/2010.

            SB160 � Still in Senate Committee of Economic Development & Regulatory Reform. 

 

 SB161 and HB4429

These two bills allow for the appointment of members of the public to the MCCA board. 

            HB4429 � Passed House on 4/1/09 and referred to Senate Committee on Economic Development & Regulatory Reform � still there.

            SB161 � Still in Senate Committee on Economic Development & Regulatory Reform.
